Terms of Service

1. Who you are contracting with
Clubhouse HQ is provided by Leighton Moore, a sole trader based in the United Kingdom ("Clubhouse HQ", "we", "us", "our"). By creating an account or using the service you are entering into a contract with Leighton Moore on these terms.
2. Acceptance
By creating an account or using Clubhouse HQ, you agree to these terms. If you do not agree, please do not use the service. You confirm you are at least 16 years old and, if you are acting on behalf of an organisation (such as a golf society), that you have authority to bind it.
3. The service
Clubhouse HQ is software for organising amateur golf societies — managing members, fixtures, results, knockouts, tours and related communications.
4. Your account
You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.
5. Acceptable use
You must not (a) use the service for unlawful purposes, (b) infringe anyone's intellectual property, (c) send spam or fraudulent content, (d) attempt to gain unauthorised access, probe, scan, scrape or interfere with the service, or (e) upload malware. We may suspend or terminate accounts that breach these rules.
6. Subscriptions, payments and Merchant of Record
Paid plans are sold and processed by our reseller Paddle. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing cycles, renewals, taxes, cancellations and refunds are governed by Paddle's Buyer Terms and our Refund Policy. Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your account or via paddle.net.
7. Intellectual property
Clubhouse HQ, including all software, designs, logos, copy and documentation, is owned by Leighton Moore and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service within the plan you have purchased. You must not copy, resell, redistribute, reverse engineer or attempt to extract the source code of the service, except to the extent the law permits.
8. Your content
You retain ownership of data and content you enter into the app (members, fixtures, results, notes). You grant us a limited, worldwide licence to host, process and display that content solely to provide the service to you and your society.
9. Warranties and availability
The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties (including merchantability, fitness for a particular purpose, and non-infringement). We do not warrant that the service will be uninterrupted or error-free.
10. Suspension and termination
You can cancel and delete your account at any time from your Settings page. We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated/serious policy violations. On termination, we will delete or anonymise your personal data as described in our Privacy Policy.
11. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or in connection with the service is limited to the fees you paid for the service in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, incidental or punitive damages, including loss of profit, data or goodwill. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
12. Indemnity
You agree to indemnify Leighton Moore against claims arising from your content, your unlawful use of the service, or your breach of these terms.
13. Changes to the service or terms
We may modify the service or these terms from time to time. We will give reasonable notice of material changes (by email or in-app). Your continued use after changes take effect constitutes acceptance.
14. Governing law
These terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
